
TERMS & CONDITIONS
This document provides the Terms & Conditions which apply to KZN Photographer Photo of the year competition 2024.
Please read the rules and terms in full and confirm that you have read and understood them by checking the mandatory checkbox on the entry form on the competition website.
The promoter of this competition is Kiley Kreations Photography (“the Promoter”), whose registered address is 39 Wakenshaw Manor Ballito Dolphin Coast 4420.
ELIGIBILITY
The competition is only open to people who are resident in KZN South Africa with no gender or age restrictions, and prize winners may be asked to provide necessary supporting documentation as proof of address. The competition is not open to Kiley Kreations Photography employees, competition’s sponsors, competition judges, or the immediate families of the aforementioned parties.
ACCEPTANCE
By entering the competition all participants and winners agree to be bound by these terms and conditions, which will be interpreted by the Promoter, in its sole discretion, and its decision regarding any dispute will be conclusive, final and binding and will not be challenged on any grounds, including without limitation, the grounds that the Promoter failed to act reasonably, fairly, in good faith or otherwise in accordance with the principles or procedural fairness.
Kiley Kreations Photography reserves the right to amend the validity dates of this competition at any time. To enter the competition, all entrants must comply with the competition by submitting the details as requested. Entries will be considered incomplete and thus disqualified if the entrant does not provide all requested information. Entry and payment may only be via the Photography Competition page www.kileykreations.com/kznphotographerphotooftheyear website and its chosen payment requirements to ensure accurate tracking of entries. No other forms of entry or payment will be allowed and no refunds will be issued.
No Photographs of discrimination, illegal activities, nude or of inappropriate nature shall be published.
COMPETITION PERIOD
The competition opens for entries at 06:00 on 20 July 2024, and closes for entries at 23:59 on 31 July 2024, with voting and judging taking place during the course of August to September 2024. Any entries received after 23h59 on 31 July 2024 will be invalid and will not be entered into the competition.
ENTRY
To enter this competition, entrants need to complete the entry form on the KZN Photographer Photo of the Year 2024 Competition website www.kileykreations.com/kznphotographerphotooftheyear, upload their images, give each photo a title, accept these Terms & Conditions, and complete payment. A maximum of three (3) images may be uploaded per entry per category. Participants may enter more than once in different categories, but will have to pay per entry. Images must have been photographed by and belong to the person entering the competition and whose name is on the entry form. Entrants must be able to supply RAW or hi-res original files if requested. Any persons who infringe on the copyright of another person will be disqualified from the competition, and further action may be taken against them. Photographers’ names and/or watermarks must not be visible on the images that are uploaded to the competition’s entry form, so that entries are kept anonymous, for judging purposes. Photographs that are uploaded and display the photographer’s name or watermark will be disqualified from the competition, and will not be judged, and entrants will forfeit their entry fee. Entry fees are R100 for 1 image entry or R200 for 3 image entry per category. For each entry, a maximum of three photographs may be entered into the competition per category. Edits, such as cropping, lighting, etc., is recommended to be kept to a minimum, and major manipulation using design software is discouraged.
CATEGORIES
NATURE
Human elements shall not be present, except on the rare occasion where those human elements enhance the nature story. The presence of scientific bands on wild animals is acceptable. Photographs of artificially produced hybrid plants or
animals, domestic and farm animals, mounted specimens, or obviously set arrangements, are ineligible, as is any form of manipulation that alters the truth of the photographic statement
WILDLIFE
Wildlife which is defined as one or more organisms living free and unrestrained in a natural or adopted habitat. Therefore, while photographs of zoo or any other animals in captivity, insects or other creatures photographed in the studio or other controlled locations are NATURE subjects. They are not WILDLIFE and could not be entered in a Wildlife section. Animals living free and unrestrained on game farms, private game reserves and National Parks are considered to be wildlife.
NOTE: Wildlife subjects are not limited to birds and mammals. Insects, reptiles, amphibians, sea creatures and botany are also eligible wildlife subjects as long as they are not captive subjects. The main subjects must be living organisms therefore landscapes are not eligible wildlife subjects.
SPORT
Sports photography covers any aspect of a sporting event. Images must depict an active pastime or recreation involving physical exertion and/or skill that is governed by a set of rules or customs and often of a competitive nature. Images in this section could include, for instance, the judge or umpire in a sporting event. Sports Action Photography depicts people in action. Images must depict an active pastime or recreation involving physical exertion and/or skill that is governed by a set of rules or customs and often of a competitive nature. The level of sport can range from children playing a sport to the Olympic Games.
STUDIO
Images captured in a controlled environment with the use of natural or artificial light source
LANDSCAPE
A genre intended to show different spaces within the world, sometimes vast and unending, but other times microscopic. A landscape comprises the visible features of an area, including physical elements such as landforms, the sea, living elements of flora and fauna, abstract elements like lightning and weather conditions.
PORTRAIT
A likeness, personality, and mood of a living subject where that subject is dominant in the image. Portraiture is not restricted to head and shoulders and may include just a part of the face, a back view or even a full length study.
OPEN
In this category the subject matter is totally open. All elements must be photographic – if graphic elements are included they should enhance the photographic image but not take over from it. All graphics used should be created by the photographer using their own artwork.
MANIPULATION (Not allowed)
Manipulation shall constitute any or all of the following modifications to the original image: Adding an element to the image that was not contained in the original capture; Removing an element from the image that was contained in the original capture; Moving or repositioning an element of the image that was contained in the original capture.
DIGITAL EDITING
In all categories ( except the OPEN category) manipulation is not allowed. In the Open category there are no restrictions whatsoever in the way authors choose to process an image. The following actions are allowed and are not seen as manipulation: Cropping and resizing. Correction of lens distortion, chromatic aberrations, purple fringing, lens vignette and vertical/horizontal perspective adjustments. Removal of dust spots or scratch marks from sensor or scanned images. Due to the limitation of digital sensors regarding dynamic range, the blending of different exposures of the same scene to broaden the dynamic range (e.g. HDR). Adjustments to exposure and contrast, including dodging and burning. Adjustment/correction of colour balance. This can either be done by selecting an appropriate white balance during the conversion in the RAW images, or by adding/subtracting colours in the photo editing software. The post capture application of digital colour correction filters like warming or cooling filters, similar to the 81 and 82 series of filters, is also allowed. Application of colour saturation. Non-selective saturation that is applied to the whole image is permissible. Reduction of digital noise, especially in high ISO images from digital cameras, or film grain in scanned images. Sharpening of the image. All modern sharpening algorithms and techniques such as edge sharpening. Luminance sharpening and mode sharpening are permissible. Retouching of portrait images are allowed in moderation.
In the case of Nature and Wildlife, HDR, stitching for panoramas and focus stacking will not be considered as manipulation and may therefore be used provided that the end result is a faithful representation of the original scene.

The committee reserves the right to request the author to submit the original RAW file or negative to verify the image’s authenticity. Where
no RAW file or negative is available, the committee will evaluate the entry and the author may be asked to submit evidence to the committee. The committee’s decision is final. By entering the competition the author implicitly accepts the ruling of the committee in this regard.
SELECTION OF WINNERS

Each photo entry will be published on our website voting page where the public can vote for their favourite photo for R5 per vote.
Voting will run until 31 Aug’24 at 9pm.
The Top 5 Finalists in each category will be determined via the public choice campaign (Top 5 with most votes in each category) whereafter the judges will select the Winners in each category from the Top 5.
The public choice winner in each category will also be awarded.
The overall winner with the highest score across all categories will win the Weekend Getaway Terms and conditions apply
WINNER ANNOUNCEMENT & NOTIFICATION
Winners will be announced on the 15th September 2024. Winners will be notified either telephonically or via e-mail within one week of the winners’ announcement, on the cell phone number or e-mail address they supplied when entering this competition. The over all competition winner will have five (5) working days to claim acceptance of their prize. Upon failure to do so, the promoter reserves the right to award a new winner, in accordance with the terms stipulated herein. The decisions of the Promoter and its judging panel are final and the Promoter shall not enter into any correspondence about the results. Entries that do not comply with these terms and conditions will be disqualified. The Promoter shall not be liable for any disruption to the competition, whether due to technical problems or otherwise, which is beyond its reasonable control. In the event of any disruption to the competition, the Promoter shall use its reasonable endeavours to remedy any disruption and resume the competition on a fair and equitable basis to the entrants. By entering the competition, entrants warrant that all information submitted by them is true, current, and complete.
PRIZE
Each Top 5 Category Finalist will receive the KZN Photographer Photo of the Year 2024 Category Finalist Certificate. Each category winner will receive the Award for KZN Photographer Photo of the Year 2024 Category Winner Certificate. There will also be a Public choice winner per Category Certificate Award. All Certificates will be sent to the winners on a downloadable Link. The overall Photo winner for KZN Photographer Photo of the Year Award will win the main Prize.
The overall Winner Prize: 2 x Night stay at a beach front property in Ballito for a family of 4. The accommodation is subject to availability during off peak times. This prize is valid for 6 months. Excludes any traveling, meals or extras.
PERSONAL DATA
Completion of a contact form is required for competition entry. The data entered into the form by the entrant is only collected, processed and used by the promoter in order to administer the competition. The Promoter keeps the data to fulfil the purposes for which it was collected or as required by applicable laws or regulations.
OWNERSHIP AND PUBLICITY
The promoter reserves the right to publish the names and photographs of the winners. Therefore, entrants understand and agree that their submission will be posted and publicly viewable. By providing a submission, you grant the Promoter the right, except where prohibited by law, to use your name for competition purposes in promoting or publicising the competition, including the right to name the winners of the prizes in public. Details of the winners may also be announced on the Promoter’s website and any other media properties that it chooses.
COPYRIGHTS AND USAGE RIGHTS
Participant retains copyrights of all submitted images and descriptions. By entering the competition, you grant KZN photographer photo of the year 2024 and its promoter a non-exclusive, royalty-free, irrevocable licence to publish images for any purpose directly connected with the competition. This include: display on the competitions web page hosted by Kiley Kreations Photography: on social media for the use in marketing and communication purposes.
RELEASE OF LIABILITY
The Promoter reserves the right to terminate the competition at any time. The Promoter cannot accept any responsibility for entries not received because they have been lost, or not received due to interrupted internet connections or miscommunications, or other electronic malfunctions. Any entries found to be fraudulent will result in the entrant being excluded from the competition. By participating, all entrants release the Promoter, its affiliates, partners, subsidiaries, officers, directors, agents, employees and all entities associated with the development and execution of this competition from any and all liability with respect to and in any way arising from participation in this competition, acceptance or use of the prizes. The Promoter reserves the right to modify or cancel the competition in the event that any portion of any website used to administer any aspect of the competition becomes technically corrupted. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries.
PRIVACY POLICY
Kiley Kreations Photography (“the Promoter”) treats all information collected as confidential and will not sell, share or rent this information to any other third-parties. The promoter reserves the right to change the terms and conditions at any given time.
